Lulama is a Consultant at Mchunu Attorneys. She specialises in Competition Law and Mergers Acquisitions. She has over 20 years of experience in this field.
Lulama served her articles with the Legal Resources Centre and started her career as an Evidence Analyst & Evidence Analyst Coordinator, and later, an Evidence Leader at the Truth & Reconciliation Commission.
Lulama practiced as a Legal Counsel at the Competition Commission where she: –
- provided legal advice on the interpretation of the Competition Act No 89 of 1998, as amended. She advised on small, intermediate and large mergers under investigation by the Commission’s M&A Division;
- advised on the approval and prohibition of the above-mentioned mergers by the Commission and also on the referral of large mergers to the Competition Tribunal;
- advised on complaints under investigation by the Commission and also prepared and drafted complaints being referred to the Competition Tribunal. Some of the matters involved in include The Competition Commission v Patensie Sitrus Beherend Beperk, the first case on abuse of dominance successfully prosecuted by the Commission under the Competition Act and the first abuse of dominance case against SAA – The Competition Commission v South African Airways (the Nationwide Complaint). Both cases are widely referred to in many aspects on the adjudication of complaints in SA; and
- advised on consent orders entered into between the Commission and private parties. For example, The Competition Commission v UDIPA, the first consent order concluded by the Commission in relation to section 4(1)(b) or cartel provisions contravention.
Lulama subsequently joined Bowman Gilfillan Inc as a Senior Associate. She later became a Partner at the firm and served as a member of the Executive Committee. She advised clients on matters relating to compliance Competition Act – ranging from providing opinions, preparing merger filings, advising on complaints investigation by the Commission and litigation thereof before the Competition Tribunal, appearing on behalf of clients before the Competition Tribunal, conducting competition audits, preparing reports for clients arising from such audits and providing training to clients’ employees and clients’ board of directors.
In relation to M&A, Lulama has extensive experience in advising on notification of both local and international transactions in South Africa in various sectors including, construction, engineering, Liquor, LPG, steel, hospital, hotel, gas, textiles, IT systems and software, security systems, steel and plastic drums, mining, mining equipment, mining support, shipping, freight forwarding services, motor vehicle manufacturing, pharmaceuticals, solar energy and military equipment.
